Texas Man Sues Date For Texting During Movie

A 37-year-old Texas man is suing a woman in small claims court who he went on a date with to the movies for texting during the film. The Austin American-Statesman reports that Brandon Vezmar is asking for $17.31, which was the price of the ticket for a 3-D showing of Guardians of the Galaxy, Vol. 2. Vezmar, who said he'd met the woman online, told the newspaper, "It was kind of a first date from hell," saying she began repeatedly texting about 15 minutes after the movie started. He said he asked her to stop, but she refused, and when he told her maybe she could go outside to text, she left the theater and never came back. He added that she left in her car, which they'd driven in together, leaving him without a ride. When he contacted her a few days later asking that she give him the money for the cost of her ticket, she refused. Vezmar's claim contends that it's about more than just the money, saying: "While damages sought are modest, the principle is important as defendant's behavior is a threat to civilized society." The American-Statesman contacted the 35-year-old woman, who asked that her name not be used, and she said, "Oh my God. This is crazy," saying she hadn't known about the small claims court action. She said she only texted two or three times with a friend who was having a fight with her boyfriend, saying, "I had my phone low and I wasn't bothering anybody. . . . It wasn't like constant texting." She said she refused to give Vezmar the money when he contacted her because he'd taken her out on a date, and also said she plans to file a protective order against him because he contacted her sister to try to get the money.
